General Terms and Conditions of Sale

These General Terms and Conditions of Sale ("Conditions") apply to all orders placed through our online store available at whipparts.com, operated by GOLDCAR RENATA BADZIO BARTŁOMIEJ KALISZ S.C. with its registered office at ul. Zadębie 17, 20-231 Lublin, Poland, NIP (Tax ID): 9462639422, REGON (National Business Registry Number): 061421317.
Our economic activity is registered in the Central Register and Information on Economic Activity (CEIDG), maintained by the Minister of Economy in accordance with the Act on Freedom of Economic Activity.

1. Scope of application
These terms and conditions apply to all orders placed in our online store. These terms and conditions also apply to entrepreneurs for future business relations, without the need for further confirmation. Unless otherwise agreed, conflicting or supplementary contractual clauses used by entrepreneurs are not accepted.

2. Contracting party, conclusion of contract, possibility of correction
The contract is concluded with the company GOLDCAR RENATA BADZIO BARTŁOMIEJ KALISZ S.C.
By placing products in the online store, we submit a binding offer to conclude a contract for these goods. You can place products in the shopping cart without obligation and modify your order at any time before submitting a binding order, using the correction tools provided and described during the ordering process. The contract is concluded by clicking the order button, which signifies acceptance of our offer for the products in the shopping cart. After placing the order, we will immediately send an email confirmation.

3. Contract language, archiving of the contract text
The contract can be concluded in Polish or English.

The text of the contract is saved and sent to the Customer on a durable medium along with the order confirmation and these Conditions. The contract text is also available in the customer panel of our store.

4. Delivery conditions
Shipping costs are added to the product prices, as detailed in the individual product offers.

Shipping is only to the address provided; personal collection or delivery to automated parcel lockers (e.g., Paczkomat) is not possible.

Free shipping within the European Union does not include islands.

5. Payment
The following payment methods are available in our online store:

Credit card: Card details must be provided during the order. After verifying the cardholder, payment is automatically processed.
Other methods managed by Shopify Payments: Apple Pay, Google Pay, and other methods indicated at the time of finalizing the order.

6. Right of withdrawal
The Customer has the legal right to withdraw from the contract as described in the instructions regarding withdrawal.

Each item can be returned without stating a reason within 14 days of purchase at the seller's expense.

7. Damage during transport
For consumers: If the delivered products are damaged, please report this to the courier and inform us immediately. Failure to report does not limit the Customer's rights in this regard, especially statutory warranty rights. However, reporting helps us assert our rights against the carrier.

For entrepreneurs: The risk of accidental loss or damage to the goods passes to the Customer upon delivery of the shipment to the carrier. In addition, the provisions of Article 563 § 1 of the Polish Civil Code apply: goods must be examined immediately after delivery and any defects reported without delay, otherwise rights will be forfeited, unless the defect was not detectable at the time of delivery. This does not apply to defects maliciously concealed by the seller.

8. Statutory warranty and commercial guarantees
In the case of consumers, statutory warranty rights provided in the consumer's country of habitual residence apply. We are obliged to provide goods in conformity with the contract. Complaints can be sent by email to vente@e-goldcar.eu or in writing to:

If the complaint is accepted, the goods must be returned at our expense. If return is difficult due to the nature of the goods, the consumer must make them available at their location.

For entrepreneurs, liability under statutory warranty is excluded pursuant to Article 558 § 2 of the Polish Civil Code, unless the seller maliciously concealed the defect.

For all: Separate guarantees (e.g., manufacturer's guarantee) may apply to some products; detailed conditions are specified in the product description or in separate information pages.

9. Liability
In any case, we are fully liable for damages caused by us, our representatives, or assistants, if they concern:

damage to life, bodily integrity, or health,
intentional breach or gross negligence of obligations,
liability for guarantees (if granted),
obligations towards the consumer.
In all other cases, our civil liability is limited to typical and foreseeable damages at the time of concluding the contract.

10. Online dispute resolution
The European Commission provides a platform for out-of-court online dispute resolution, available at: https://ec.europa.eu/consumers/odr/.

11. Prices
All prices are gross prices (including VAT).

12. Final provisions
For contracts with entrepreneurs, Polish law applies, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG).
For disputes arising from concluded contracts, the exclusive jurisdiction is the location of our company, if the party is an entrepreneur, a legal entity under public law, or a special fund under public law.
